The Scoop on Batching Cocktails

You may have heard that batching of cocktails is now legal in Wisconsin. 2023 Wisconsin Act 73 changes current law to legalize and regulate batching of cocktails.
 
According to the Wisconsin Department of Revenue, beginning May 1, 2024, "Class B" (liquor) retailers may, on their licensed premises, prepare, store, and dispense premixed drinks of liquor IF they comply with the following regulations:
  • The liquor used in the premixed drink was purchased and obtained from legal sources (i.e. permitted Wisconsin wholesalers).
  • The premixed drink is provided to the customer in a container that is not bigger than 72 ounces.
  • The premixed drink is not stored or dispensed from a wine bottle or reused liquor bottle.
  • The premixed drink is not stored in a container for more than 48 hours prior selling it to a customer.
  • The bulk container used to dispense or store the premixed drink is not bigger than 5 gallons.

​Also, the container used to prepare, store, and/or dispense the premixed drink needs to be labeled with the following information:
  • The container holds a batch of premixed drinks
  • The date and time the batch was prepared
  • Expiration Date—which is 48 hours after the batch was prepared
  • The words, "contains alcohol"
  • The name of the person who prepared the batch
  • The ingredients of the batch, or the recipe title if the ingredient list is kept somewhere on the licensed premises and is available for inspection
  • Any other information the Division of Alcohol Beverages requires by rule
